Job Summary:
The general purpose of the role is to develop and implement a compliance framework, including management plans, policies, processes, and monitoring to ensure Milpark Education complies with relevant laws and regulations, statutory and supervisory requirements. The successful candidate will also be responsible for regulatory compliance and risk management as it pertains to the POPI Act.
Responsibilities:
•Compiles and establishes the compliance framework for the institution.
•Directs the development, implementation and oversight of policies and procedures designed to mitigate organisation’s compliance related risks.
•Co-ordinates the continuous maintenance and improvement of the compliance framework.
•Keeps the organization informed about regulatory developments within the general corporate and higher education industry that will impact the business
•Develops, initiates, maintains, and revises policies and procedures for the general operation of the compliance program and manages day-to-day operations of the program
•Collaborates with other departments and management to direct compliance issues to appropriate existing channels for investigation and resolution
•Acts as an independent review and evaluation body to ensure that compliance issues/concerns within the organization are being appropriately evaluated, investigated, and resolved
•Assesses the risk of non-compliance by business units with POPI/privacy programme
•Administers a privacy programme that assures compliance with laws related to privacy as well as access to information, namely POPIA and PAIA
•Takes up or supports the duties of the Deputy Information Officer as determined by the Information Regulator, ensuring compliance with the POPIA and PAIA.
•Understands the impact that information security practices in the business have on compliance with privacy directives
•Serves as liaison to regulatory bodies for matters relating to POPIA and PAIA
•Conducts awareness and training programmes on POPIA and compliance with related policies and procedures for all employees, contractors, and executives
•Provides leadership to appropriate boards and committees as relates to POPIA and other compliance matters
•Review the Company’s internal controls, policies and procedures and ensure that they conform to legislation.
•Assists in maintaining the Company’s compliance with both industry and business best practices, codes, and legislation.
•Identify potential compliance breaches and investigate compliance irregularities or areas of concern and assist with incidence response management.
•Where possible non-compliances exist, through collaboration with other stakeholders, provide a risk analysis and propose a workable solution to ensure compliance
•Maintains the key business policies
•Ensures compliance records are up to date
•Maintains the compliance procedures and manuals
•Monitors and interprets industry developments and relevant laws and regulations.
•Establishes and embeds a compliance culture across the Milpark Education and its departments and schools.
•Prepare compliance reports, making recommendations and raising concerns where appropriate
•Documenting information processing procedures (data mapping or mapping of information flows)
•Working with Information Technology Department to evaluate and further develop data protection and security policies to meet regulatory and contractual requirements.
•Creates, implements, and maintains processes for managing contracts and third parties.
•Drafting forms and contracts appropriate for meeting data protection requirements
•Selecting employees, service providers and others to be involved in the processing of personal information
•Handling queries and complaints relating to personal information and access to information.
•Works with key stakeholders to develop and maintain risk registers and risk management plans.
Requirements
Education & Experience Requirements
•A relevant Bachelor Degree in Risk Management / Compliance / Legal or Governance
•5 + years’ related experience in risk management, compliance, legal or governance
•Working knowledge of POPIA and PAIA
•Registered with Institute of Risk Management South Africa (IRMSA) (advantageous)
•Registered with Compliance Institute Southern Africa (CISA) (advantageous)
